Montesquieu said that liberty is "a tranquillity of mind arising from the opinion each person has of his safety." I never thought of liberty in this way but it does make sense. This definition of Liberty means that we are able to live under laws that allow us to do as much as possible while being safe. This does not mean that we can do whatever we want, as there does need to be some order in society, but it allows us to do as much as possible. I think this is a more accurate description of liberty because it ensures that everyone is safe while being free. Something I found interesting about Montesquieu’s view on Liberty is what the government needs in order to have it. Those features are pretty much the ones that we have in the United States Government today which are the executive, legislative (one composed of two houses), and judicial branches. I found this interesting because we have the features of government needed for liberty, but I do not truly believe that we have what Montesquieu believes is liberty. As I continued reading I started to see why. The article continued to talk about what type of laws there would need to be to have Liberty. These laws would only be ones that would protect public order and security. That means there should not be laws prohibiting what does not need to be prohibited. The laws should also make it as easy as possible for innocent people to prove that they are innocent. And I think that in the U.S. we do have a lot of laws that prohibit things that do not need to be prohibited. I think that this is one of the main things keeping the U.S. away from Liberty.
